SCL Nishimura has a strong and experienced Employment and Labour practice group in Thailand. We have developed in-depth expertise in the field from a legislative perspective and have extensive experience in both advisory and litigation work.
We are seeking a motivated lawyer with experience in Labour and Employment law. Furthermore, experience with visa and work permit applications, personal data protection law, and HR due diligence/compliance/health check is also preferred.
Key Responsibilities:
- Researching and providing legal advice on various employment-related issues such as termination of employment; restrictive covenants; relocation of places of business; benefit plans; change of incentive schemes and other agreements relating to conditions of employment; changes of post, interpretation of wages; outsourcing of employment; overtime and retirement; mergers and acquisitions and restructuring; conflicts within the workplace; provision of comprehensive advice in connection with Social Security law, the Labour Protection law, the Provident Fund law, the Labour Relations law, the Civil and Commercial Code pertaining to the hire of services, the Workmen’s Compensation law, and the Establishment of and Procedures for Labour Court law and other areas as may be required from time to time;
- Drafting, reviewing and advising on employment agreements, work rules, internal announcements, internal and global policies, secondment agreements, notices of termination, resignation letters, letters of release and other employment-related documents;
- HR due diligence;
- HR compliance/health check;
- Drafting, reviewing and advising on legal documents required for data protection law compliance in the workplace;
- Advising on visa and work permit applications;
- Assisting the litigation team in litigating labour cases (both labour authority and court cases); and
- Performing other tasks as assigned by partners or senior lawyers that may include tasks related to other corporate and commercial laws.
Qualifications:
- LL.B. in Thailand with good knowledge of law required
- Possess a lawyer’s license
- A minimum of 1-2 years’ experience as an employment lawyer
- Excellent communication skills, both written and verbal
- Ability to handle cases independently with minimum supervision as well as work in a team
- Highly analytical with strong attention to detail
- Good command of written and spoken English
